Session Synopsis

The new FLSA overtime regulations were to kick in on December 1, 2016, and are being called “the most significant change to the economy in a decade”. The new proposed regulations significantly alter the salary threshold under which white-collar employees are exempt from overtime compensation requirements under the Fair Labor Standards Act.

The final rule will raise the current minimum salary threshold from $455 per week ($23,660 for a full-year worker) to $913 per week ($47,476 for a full-year worker). This new threshold more than doubles the minimum salary currently guaranteed to most exempt employees. The U.S. Department of Labor will revise (presumably increase) the salary thresholds every three years.

Wage and hour litigation, whether based on overtime compensation, minimum wage or a failure to pay wages, has been increasing. With all of the attention that has been and will be given to the new overtime regulations, litigation is sure to increase. With a proper training and communication plan, businesses can best protect themselves against unnecessary litigation and establish a solid defense should such litigation commence.

These changes impact many aspects of your business.  You will want to update job descriptions for employees to ensure that language for salaried employees is robust enough to withstand scrutiny.  Employee Handbooks may need updating and you will want to review if there are any benefit differences between salaried and hourly paid employees.

Diane Biersteker started her consulting practice, Human Resources Consulting LLC, six years ago with the idea of sharing her knowledge of HR with that small to medium sized business that didn’t need a full time HR staff, but needed help on an as needed basis. Diane has over 35 years of proven expertise across all facets of Human Resources and general business operations. She is a veteran of many successful M&A transactions for multiple companies, working actively from Due Diligence through Transition to Integration. Diane and her team provide Strategic and Tactical Human Resources support to a large group of clients across Northeast Wisconsin.   Since the firm was started, HR support has been provided to over 175 different companies and organizations.

Diane previously served as Chief Administrative Officer for WS Packaging Group, North America’s 2nd largest printing, packaging and promotional manufacturer, originally joining the company as a consultant, and creating its first Human Resources Department. She grew the Human Resources staff to a team of 20+ HR professionals across the United States and Mexico to include 18 plants and 1900 employees. Working with the Executive team, a contemporary Human Resource organization was formed, serving as a true “strategic partner” with the Operations team of the corporation. She also held acquisition responsibility for due diligence through transition to full integration into the corporation for over 15 successful acquisitions.

Prior to WS Packaging Group, Diane was the Vice President of Human Resources for Cruisers Inc. (now known as KCS International for 13 years.  Hired to start their first HR department, she managed that and much more as part of the executive team.
